U.S. Supreme Court Grants Writ of Certiorari in Bilski Case On June 1st, 2009, the U.S. Supreme Court granted a petition for a writ of certiorari in the closely watched Bilski patent case. A Federal Circuit decision dated October 30, 2008, interpreted the law regarding patentable subject matter under 35 U.S.C. 101 in a manner widely viewed to narrow the scope of what can be patented, particularly with respect to methods. Claim 1 of the patent at issue in Bilski is drawn to "A method for managing the consumption risk costs of a commodity sold by a commodity provider at a fixed price...". The Federal Circuit found this claim to be unpatentable under 35 U.S.C. 101, because it did not satisfy the "machine-or-transformation" test. |
